Subclass 820 / 801
Partner Visa (Onshore)
The onshore Partner visa lets the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen live in Australia. You apply for the temporary (820) and permanent (801) visas together; the permanent stage is usually decided around 2 years later.
Key eligibility
- Be married to, or in a de facto relationship with, an eligible sponsor.
- Be sponsored by your partner (sponsorship is assessed separately).
- Demonstrate a genuine and continuing relationship.
- Meet health and character requirements.
Evidence of your relationship
- Financial aspects — joint accounts, shared bills, major purchases.
- Nature of the household — shared lease/mortgage and living arrangements.
- Social aspects — photos, joint travel, statements from family and friends.
- Commitment — future plans and the length and nature of the relationship.
Subclass 309 / 100
Partner Visa (Offshore)
The offshore Partner visa is for partners of an Australian citizen, permanent resident or eligible New Zealand citizen who are outside Australia when they apply. It grants a provisional visa (309) first, with the permanent visa (100) generally decided around 2 years later.
Key eligibility
- Be married to, or in a de facto relationship with, an eligible sponsor.
- Be outside Australia when the provisional visa is applied for and decided.
- Be sponsored by your partner and show a genuine, continuing relationship.
- Meet health and character requirements.
Evidence of your relationship
- Financial, household, social and commitment evidence (as for the onshore visa).
- Communication records if you have spent time apart.
- Statutory declarations supporting the relationship.
Subclass 300
Prospective Marriage Visa
The Prospective Marriage visa (subclass 300) lets you come to Australia to marry your prospective spouse, who must be an Australian citizen, permanent resident or eligible New Zealand citizen. After marrying, you can apply for a Partner visa.
Key eligibility
- Be aged 18 or over and intend to marry your prospective spouse.
- Have met in person and know each other (generally face-to-face).
- Be sponsored by your prospective partner.
- Meet health and character requirements.
After you arrive
- Marry your partner during the visa validity period.
- Apply for a Partner visa (820/801) to stay permanently.
- You can travel in and out of Australia while the visa is valid.
